BOOKING AND RECEIVING A CONSULTATION

AVIVA DIGITAL GP IS PROVIDED FOR AVIVA BY SQUARE HEALTH. WHEN YOU BOOK A SQUARE HEALTH CONSULTATION WITHIN AVIVA DIGITAL GP YOU ENTER INTO A CONTRACT WITH SQUARE HEALTH UNDER WHICH SQUARE HEALTH WILL PROVIDE THE SQUARE HEALTH CONSULTATION THROUGH A SQUARE HEALTH PANEL MEMBER. THESE TERMS APPLY TO AND GOVERN THE PROVISION BY SQUARE HEALTH OF CONSULTATIONS.

TO BOOK AND RECEIVE A SQUARE HEALTH CONSULTATION YOU MUST ACCEPT THESE TERMS. BY CLICKING THE “AGREE” BUTTON BELOW YOU AGREE TO BE BOUND BY THESE TERMS (INCLUDING ANY ADDITIONAL TERMS WHICH ARE REFERRED TO IN THEM) AND YOU ALSO AGREE TO THE COLLECTION, HOLDING AND USE OF PERSONAL INFORMATION AND DATA IN ACCORDANCE WITH THESE TERMS,SQUARE HEALTH’S PRIVACY POLICY.

THIS SERVICE IS NOT APPROPRIATE FOR TREATMENT IN AN EMERGENCY OR LIFE THREATENING SITUATION E.G. CHEST PAINS, BREATHING PROBLEMS, SUSPECTED STROKE OR BONE FRACTURE, SEVERE BLEEDING OR LOSS OF CONSCIOUSNESS. Introduction

The following terms and conditions (the ‘Square Health Provider Terms’) are a legal agreement between You and Square Health for a Square Health Consultation. Please read these Square Health Provider Terms carefully before accepting them. By clicking the “Agree” button, You signify that You have accepted these Square Health Provider Terms and agree to be bound by them.

A Square Health Consultation may be booked and provided only for a person who is entitled to receive benefits under Aviva Digital GP, who is aged 16 or above, and who is ordinarily resident in the United Kingdom, Channel Islands or Isle of Man. If the Square Health Consultation is for a Child, the Square Health Consultation must be booked by the Principal Member who is resident at the same address as the Child.

By booking a Square Health Consultation You represent and warrant that You are aged 16 or above and ordinarily resident in the United Kingdom, Channel Islands or Isle of Man.

You will be subject to the policies and terms and conditions in force at the time that you book the Square Health Consultation, unless any change to those policies or terms and conditions is required to be made by law or governmental authority.

Square Health is registered with and regulated by the Care Quality Commission in England (whose website is www.cqc.org.uk).

Definitions

In these Square Health Provider Terms (including the Introduction section above):

App refers to the mobile application which has been developed by Square Health to provide access to Aviva Digital GP

App Terms refers to the terms and conditions governing the provision and use of the App

Aviva refers to the relevant Aviva company which provides the policy under which access to Aviva Digital GP is included as a non-contractual value added benefit, the ultimate parent undertaking of which is Aviva plc (registered in England under number 02468686)

Aviva Digital GP refers to the GP and pharmacy services which are provided by Square Health and/or other Service Providers under the Aviva Digital GP brand

Child refers to a person up to the age of 16 who is a natural or legally adopted child of the Principal Member

Principal Member means a person eligible to access Aviva Digital GP as a non-contractual value added benefit under certain Aviva products

Service Provider refers to a provider of medical or other healthcare services within Aviva Digital GP

Square Health refers to Square Health Limited, a private limited company incorporated in England and Wales under company number 7054181 with its main business address and registered office at Crown House, William Street, Windsor, Berkshire SL4 1AT, and We, Us, Our, Ours and Ourselves also refer to Square Health

Square Health Consultation refers to a consultation within Aviva Digital GP which is provided by Square Health, whether with a GP or consultant or any other doctor or healthcare practitioner, and includes any related services that may be provided (such as prescription services, provision of a sick note or referral letter)

Square Health Panel Member refers to a doctor or other healthcare practitioner who is a member of a Square Health panel of doctors or other healthcare practitioners for the provision of Square Health Consultations

Square Health Portal refers to the portal used by Square Health and Square Health Panel Members in order to provide Square Health Consultations (including a database provided and maintained by Square Health)

Square Health Provider Terms refers to these terms and conditions

You, Your, Yours and Yourself refer to you.

Which terms and conditions apply

Square Health will provide the Square Health Consultation in accordance with these Square Health Provider Terms using a Square Health Panel Member. These Square Health Provider Terms will also apply to any follow-up Square Health Consultation that may be required and which is booked either by Square Health or by a Square Health Panel Member or by an Aviva Digital GP administrator.

The App is provided by Square Health subject to the App Terms and the App Terms apply to the use of the App to access Aviva Digital GP and the service elements within it. The App Terms may be viewed here.

If You have any questions about a Square Health Consultation, please contact Square Health using the contact details provided in the App.

Who is responsible for payment for a Square Health Consultation

Subject to the terms relating to Aviva Digital GP, all or part of the cost of the Square Health Consultation will be funded by Aviva, subject to Aviva’s applicable terms and conditions. You will be liable for any charges which are not met by Aviva, including any incidental or other charges which are stated to be payable directly by You, for example related prescription services or provision of a sick note. Aviva is not responsible for providing the App and is not responsible for the Square Health Consultation or for any advice given in the Square Health Consultation. Square Health is not responsible for any consultation or advice provided by a third party under a service within Aviva Digital GP which is not provided by Square Health.

Information about You or Your Child

By agreeing to these Square Health Provider Terms You consent to Square Health processing Your or Your Child's personal data and special category personal data for the purposes and in the ways described below.

In order to service the contract you have, Square Health and/or the relevant Panel Member may collect personal data about You or Your Child (as appropriate). As this service involves the provision of health or social care, this will involve processing Your or Your Child’s health data (special category data). Such data may be held either within the App or the Square Health Portal. The following kinds of personal data about You or Your Child may be collected and held:

  • Aviva Digital GP member and patient information
  • Information regarding the health or medical conditions or complaints presented
  • Other information regarding the health and wellness of You or (if appropriate) Your Child
  • Information regarding investigations, medication and/or other treatments, therapies or onward referrals prescribed or recommended or declined
  • Information regarding the diagnosis, advice and outcomes.

Square Health Consultations are recorded for quality, training and monitoring purposes. This may include audio, video or both. The recordings are likely to contain personal data of the kinds described above.

All personal data collected by Square Health or a Square Health Panel Member in the course of booking and providing a Square Health Consultation may only be held and used in the ways set out in Square Health’s privacy policy which may be viewed here. In particular, Square Health and Square Health Panel Members may use information about You or Your Child for the following purposes:

  • In order for Square Health to provide a Square Health Consultation using a Square Health Panel Member
  • In order for the Square Health Panel Member to conduct a Square Health Consultation with You or (if appropriate) Your Child
  • In order to prescribe or recommend to You or Your Child any medication, treatment, investigation or onward referral that the Square Health Panel Member may consider appropriate or desirable
  • In order to process any prescription or recommendation to You or Your Child for medication or treatment or investigation
  • In order to provide additional services agreed with You
  • (Subject to Your consent or in limited other circumstances as described in Square Health’s privacy policy) to provide information to Your NHS GP.

Square Health will not provide any special category data to Aviva and will only send Aviva anonymised and aggregated information about Square Health Consultations, for example the total number of Consultations booked and received during a specific time period. If Square Health is required to disclose special category data to Aviva, for example in relation to a complaint, you will be asked to expressly consent to such disclosure.

Information of the kinds described above may also be collected in any follow-up Consultation and may be processed in the same ways.

Please be aware that internet transmissions are never completely private or secure and that any message or information You send using the App may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.

Fair use

Square Health applies a fair usage policy and may, in its discretion, decline to provide a Square Health Consultation and/or suspend services to You if it reasonably considers that You are acting in breach of its fair usage terms or in bad faith. Square Health’s current fair usage terms may be viewed here.

Breach of the Square Health Provider Terms

Failure by You to comply with the Square Health Provider Terms may result in Square Health taking all or any of the following actions:

  • issue of a warning to You;
  • immediate, temporary or permanent withdrawal of Your right to book Square Health Consultations;
  • cancellation of any Square Health Consultations previously booked;
  • legal proceedings against You;
  • (if Square Health considers it to be appropriate) disclosure of information to law enforcement authorities.

There may be links in the App which take you to websites not provided by us. We are not responsible for websites not under Our control, and We have not checked and approved their content or their privacy policies (if any).

Square Health's liability

The services within Aviva Digital GP have been developed to standard specifications and not to meet any particular specifications or requirements of You, and they are supplied ‘as is’. It is Your responsibility to check that the services within Aviva Digital GP are suitable for You. We are only responsible for services within Aviva Digital GP which are provided by Us and Our Square Health Panel Members. We are not responsible for services provided by other Service Providers.

Subject to the previous paragraph, We accept responsibility for direct loss suffered by You (or, where applicable, Your Child) if We fail to comply with these terms or fail to use reasonable care and skill. We do not seek to exclude or limit in any way Our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by Our negligence or the negligence of Our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.

Except where it would be unlawful to do so, we do not accept responsibility for any other loss or damage suffered by You or any other person.

Other provisions

We may transfer Our rights and obligations under these Square Health Provider Terms to another organisation. We will always tell You in writing if this happens. You may only transfer Your rights or Your obligations under these Square Health Provider Terms to another person if We agree in writing.

Even if We delay in enforcing Our contract with You, We can still enforce it later. If We do not insist immediately that You do anything You are required to do under these Square Health Provider Terms, or if We delay in taking steps against You in respect of Your breaking Our contract, that will not mean that You do not have to do those things and it will not prevent Us taking steps against You at a later date.

We may communicate with You by email, by SMS or by pre-paid post, in accordance with our privacy policy, using the contact details You have provided to Us.

Which laws apply to these Square Health Provider Terms and where You may bring legal proceedings

We hope we are able to satisfy any complaint You make to us. If You are not satisfied with the outcome you can still bring legal proceedings. These Square Health Provider Terms are governed by English law and You can bring legal proceedings in the English courts in respect any claim or dispute arising from, or related to, the Square Health Consultation. If You live in Scotland You can bring legal proceedings in either the Scottish or the English courts. If You live in Northern Ireland You can bring legal proceedings in either the Northern Irish or the English courts.
